SEMINAR: Attorneys David Atkins and Michael Kurs Discuss Developments In Antitrust Law Affecting the Regulation of Licensed Professionals
Pullman & Comley attorneys David P. Atkins, chairman of the Professional Liability section of the firm's Litigation Department, and Michael A Kurs, member of the firm's Health Care practice area, jointly conducted a seminar for the Connecticut Bar Association entitled "Teeth Whitening And Antitrust Immunity: Are State Licensing Boards Exposed?”
The roundtable discussion focused on last year's Supreme Court decision in North Carolina State Board of Dental Examiners v. Federal Trade Commission (2015), in which the court held that members of a state professional licensing board or tribunal who are "active participants" in the same “market” as the professionals they regulate do not automatically enjoy state-action immunity from antitrust damages actions.
The program directly focused on the implications of the decision on the Connecticut health care industry, as well as other licensed professionals.
