David Atkins Speaks About Criminal Prosecution
Pullman & Comley Litigation Department and Professional Liability Section Chairman David Atkins was quoted in “Questionable Advice To BNP On Sanctions Won't Haunt Cleary,” an article about the criminal prosecution of the BNP Pariabas Bank and the role of the bank’s law firms in the underlying transactions.
According to David, "I have seen cases in which a sophisticated business client claims that, but for the allegedly faulty advice of its law firm, it would not have been criminally prosecuted. But holding the firm liable for malpractice is a steep climb in the event the firm expressly warned the client of potential criminal exposure.”
