IN THE NEWS: Jonathan Orleans Comments on Recent Supreme Court Decision on Employment Discrimination Case
In Bill Fallon's article, "When Romance Leads to a Reprimand," Pullman & Comley Labor and Employment attorney Jonathan B. Orleans commented on a recent Supreme Court decision on Thompson vs. North American Stainless that the fiancé of a fired worker possessed protections against retaliation.
According to Jon, "It certainly appears that this court is unanimous in taking a broad view of the protection provided to employees by the anti-retaliation provisions of our employment discrimination laws.”
He added: "It seems likely that future decisions will relate this issue to the employer’s motivation for the discharge; that is, if the firing decision doesn’t stand on its own merits, but was made because another employee complained about discrimination of some kind, the person fired will have a right to sue for retaliation.”
