Judge Robert Holzberg (Ret.) Quoted on Corporate Crisis Investigations in Forbes Article
Judge Robert Holzberg (Ret.), who leads Pullman & Comley’s Investigations practice, was quoted in a Forbes article, “Who Should Investigate the Cause of a Corporate Crisis?” about the factors business leaders need to consider when selecting an investigator for a crisis which occurred at their own organization. In many cases, it makes sense to hire outside experts.
While an investigation handled internally may be criticized as biased, “The principal reason for retaining outside experts or counsel is to assure the independence of the investigation and to instill confidence in the public and the corporation’s stakeholders that the investigation is indeed thorough, impartial and free of any taint of influence by the company’s officers or directors,” Judge Holzberg said. “Outside counsel or experts are in a superior position to insist on full access to records, personnel and policy and internal deliberations that almost always are critical to the integrity and credibility of the final investigative report.”
