Russell Anderson Quoted in ALM Article on Data Privacy Laws Following Texas Lawsuit
Pullman & Comley Privacy and Data Security attorney, Russell F. Anderson was quoted in an ALM article, "Allstate Is Using Cell Phone Data to Raise Prices, Attorney General Claims,” which covered Texas Attorney General Ken Paxton’s lawsuit against Allstate alleging that Allstate and its subsidiary Arity violated Texas’ comprehensive data privacy law by collecting and selling mobile device data without consumer consent to justify raising insurance rates.
Russ noted, "It’s likely we’ll see other states creating laws or joining actions related to this type of data collection." He added that while there has been interest in enacting a similar federal data privacy law, discussions often stall over a right of private action and the extent to which the new federal law will preempt state laws.
