Overview

During his career,  Michael A. Kurs has handled matters for mental health and substance use treatment providers including psychiatric hospitals, methadone maintenance treatment and detoxification programs, community mental health programs, and for other organizations and individuals working in the field of mental health and substance use treatment. He has health care law experience representing private and not for profit providers in the areas of billing audits, drug control, reimbursement, certificate of need, licensure, HIPAA and confidentiality, antitrust, provider agreements, fraud and abuse and program integrity, clinical trials, ethics and standard of care issues.

    Experience

    • Counsel and advice to institutions and professionals regarding healthcare and corporate compliance issues including Stark, antitrust, anti-kickback, drug enforcement administration, HIPAA and the rules and regulations governing alcohol and substance use treatment records and care
    • Administrative agency proceedings for private and not for profit clients including complaint investigations, rate cases, certificate of need proceedings, and bid contests
    • Representation of targets of government investigations including investigations related to fraud, abuse and overpayments by federal and state authorities
    • Successful defense of complex standard of care cases and other complaints against providers
    • Interceded with Commissioner to maintain program funding for provider undergoing multiple investigations
    • Obtained same day release for client’s employee taken into custody for interference with execution of a search warrant/no further action taken against employee or her treatment program
