Pullman & Comley Hospitality Team Successfully Represents New Haven Nightclub in NLRB Win

Pullman & Comley Labor and Employment attorney Ryan O'Donnell was mentioned in a Law360 article on a labor union matter involving Toad's Place, an iconic nightclub in New Haven, Connecticut. Ryan, who leads the firm's Hospitality practice, helped the establishment defeat a petition for a union representation election.

National Labor Relations Board (NLRB) Regional Director Laura Sacks rejected the petition, ruling that some of the workers the union sought to represent are actually security guards who can't share a bargaining unit with nonguards. 

According to Law360, in the June 5 decision and order, Ms. Sacks "agreed with Toad's Place that its 'loaders' are technically security guards, as they perform ample security work in addition to their tasks loading and unloading gear for the bands that play at the club."

The loaders, because they are technically security guards, cannot be represented by the same bargaining unit as their nonguard co-workers under Section 9(b)(3) of the National Labor Relations Act , Ms. Sacks said.
